Terms & Conditions of Entry and Participation

DEFINITIONS

 

“Event(s)” means any event hosted by BTR - Liverpool Skyline Half Marathon & 10 Mile race, Mersey Tunnel 10K, Port Sunlight 10K, 5K or dual event, Run For the 96/5K & 1 mile fun run, If You Know Your History 5K, Tour Of Merseyside, Wirral 10 Mile / 10K race, Off Road 8, Liverpool Santa Dash & Mini dash, Grinch 5K and Medal Muddle race series.

 

“Event Organiser” means BTR Liverpool Limited a registered company in England & Wales (company number 6997275).

 

“Participant” or “you” or “your” means the named person on the completed Online Registration Form.

 

“Alternative Event” means the Event(s) delivered in such a way as the Event Organiser deems prudent and necessary, in response to a Force Majeure Event and/or any other reason deemed necessary by the Event Organiser that would materially impact on the delivery of the original Event(s).

 

“Charges” means any associated administration fee charged to the Participant during the registration process regarding their race place.

 

“Communicable Disease” means any actual or anticipated disease which is contagious between people (whether currently known or not, or whether foreseeable or not), including COVID-19.

 

“Communicable Disease Guidelines” means rules and regulations provided by the UK government and/or local government and/or sport governing body, that are applicable to mass participation Event Organisers to minimise the transmission of any communicable diseases (whether foreseeable or not) such as, but not limited to, actual or potential outbreaks of disease, epidemics or pandemics.

 

“COVID-19” means the coronavirus disease known as COVID-19 and which is caused by the virus named the severe acute respiratory syndrome coronavirus 2 (SAR-CoV-2) and at the time of these Terms and Conditions has been officially designated a global pandemic by the World Health Organisation. 

 

"Data Protection Laws" means the Data Protection Act 2018, Data Protection Directive (95/46/EC) and the UK General Data Protection Regulation. 

 

“Entry Confirmation” means confirmation of a Participant’s successfully completed Online Registration Form (sent via email from the Event Organiser and/or Nifty Event Services to the entrant).

 

“Event Agents and Guests” means those associated with the production and undertaking of the Event(s) or Virtual Event(s)  that the Event Organiser has requested to attend or to provide a service. Event Agents and Guests does not include the Participant or the general public or spectators.

 

“Event Fee” means the cost of one(1) Race Place in the Event(s) or Virtual Event(s) that is to be paid by the Participant in order to take part in the Event(s) or Virtual Event(s), which is detailed on the online entry system and on the Website, plus any associated Charges or additional extras added on during completion of the Online Registration Form.

 

“Event Marshals” means volunteers associated with the marshalling of the Event(s).

 

“Event Service Providers” means any contractor that provides a service deemed necessary to the successful completion of the Event(s) or Virtual Event(s) by the Event Organiser.

 

“Force Majeure Event” means an event beyond the reasonable control of the Organiser, including but not limited to: strikes, lock-outs or other industrial disputes (whether involving the workforce of the Event Organiser or others), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation, direction or action by a government or public authority, accident, breakdown of plant or machinery, fire, inclement weather, flood, storm, communicable disease, national mourning, nuclear risks and chemical and biological weapons or hazards, act of terrorism, demonstration, march, request of an authoritative body such as the police or fire service, any order of repatriation, internment, imprisonment, deportation or the refusal of permit to enter any country where the Event(s) is to be held, seepage and/or pollution and/or contamination or default of a subcontractor.

 

“Fun Run Event” means a subsidiary non-competitive Race organised over a predetermined course on the same day as a main Event(s).

 

“Medical Provider” means the provider of medical services at the Event(s).

 

“Online Registration Form” means the pages within the Race Entry Providers website that must be completed by the Participant to obtain a Race Place in the Event(s) or Virtual Event(s).



 

“Personal Data” means the Participant’s name, delivery address, email address, age, phone number, medical conditions, race number, gender, t-shirt size, emergency contact information, and such other information collected on the Online Registration Form, and information about your use of the Website including details of your internet protocol address, browser version, operating system, cookie details, the content viewed, duration and your navigation of our Website.


 

“Parties” means the Event Organiser and the Participant.

 

“Privacy Policy” means the policy available on the Website, which sets out how the Event Organiser handles and processes the Participant’s Personal Data.

 

“Race” means any Event(s) organised by the Event Organiser. 

 

“Race Day” means the day in which the scheduled Event(s) are due to take place. 

 

“Race Charity” means any charity which has obtained Race Places for the Event(s) or Virtual Event(s) through the Event Organiser.

 

“Race Entry Provider” means Event Track a registered company in England & Wales (company number 6997275).

 

“Race Place” means a Participant’s confirmed place in the Event(s) or Virtual Event(s) secured by paying the Event Fee and successful completion of the Online Registration Form. 

 

“Sponsor(s) & Partner(s)” means a business entity, individual, charity, group or organisation that has purchased a sponsorship package from the Event Organiser or provides a service in relation to the running of the Event(s) or Virtual Event(s).

 

“Terms and Conditions” means these participant terms and conditions, relating to the Event(s) or Virtual Event(s), as set out below.

 

“Virtual Event(s)” means events and any other event hosted by the Event Organiser with no physical infrastructure or requirement to attend a specific location, to be completed by the Participant in their own time and on their own route, usually between a specified period of dates. 

 

“Website” means www.btrliverpool.com

 

 1. ENTRY TO THE EVENT(S) & RULES

1.01   The following Terms and Conditions govern the entry to any Event(s) or Virtual Event(s) organised by the Event Organiser.

1.02   Entry to the Event(s) or Virtual Event(s) shall be via acquiring a Race Place in the Event(s) by completing the Online Registration Form.

1.03   The Participant shall receive an Entry Confirmation email following completion of the Online Registration Form. If an entrant does not receive an Entry Confirmation email and no monies have been deducted from the Participant’s payment method of choice, the Participant’s registration has not been successful and they do not have a Race Place in the Event(s) or Virtual Event(s).

1.04   A Participant agrees that they shall at all times ensure their details, in particular their name and contact details, are kept up to date on the Online Registration Form. The Participant should notify the Event Organiser of any change of address or contact details. The Participant should have an allocated username and password which will allow them to make this change online. Alternatively, the Participant can contact the Event Organiser by emailing alan@btrliverpool.com

1.05   The Race(s) are registered by UK Athletics (UKA) and run under the UKA rules for competition. The Participant must abide by the UKA rules and regulations.

1.06   The relevant discount (currently £2) will be given to a Participant who is affiliated to UKA at the time that they complete the Online Registration Form for the Event(s). No discount is offered for Virtual Event(s).

1.07   Under UKA rules and regulations, the following minimum age restrictions apply as at the date of the Race Day:


(i) 15 (fifteen) years in respect of the Mersey Tunnel 10K, Wirral 10K, Port Sunlight 10K, Port Sunlight 5K


(ii) 17 (seventeen) years in respect of the Liverpool Skyline Half Marathon & 10 Mile race, Wirral 10 Mile and 10K race


(iii) 18 (eighteen) years in respect of the Tour Of Merseyside.

1.08   The Event Organiser BTR Liverpool is affiliated to England Athletics, 2021 / 22

 

1.09   The Event Organiser ensures the Event(s) course is accurately measured by a qualified UKA official, and the current course measurement certificates are all correct.

 

1.10   The Event Organiser reserves the right to refuse or cancel applications for Race Places, including duplicate applications at any time. 

 

1.11   The Participant must ensure that they have the correct equipment, footwear and clothing for the Event(s) with reference to their personal requirements and the weather conditions on Race Day.

 

1.12   The Participant in the Event(s) may not compete with any pet or other animal.

 

1.13   Bikes, scooters, roller skates, pushchairs or any kind of mechanical aid (except non-racing wheelchairs) are strictly prohibited from the Event(s) course on Race day.

 

1.14   Pets and other animals and pushchairs are welcome in all Fun Runs organised by the Event Organiser.

 

1.15   If a Participant wishes to race in a wheelchair and/or with a guide runner please contact alan@btrliverpool.com stating clearly in the subject title which Event(s) you are referring to, so the Event Organiser can discuss the suitability of the course with you. 

 

1.16   It is strongly recommended that only experienced wheelchair users attempt the Event(s) unaided. Please note that it is the Participants responsibility to ensure that their wheelchair is well maintained and suitable for such Event(s). The Event Organiser requests the wheelchair Participant respects other Participants in the Event(s) and that the wheelchair Participant operate their wheelchair in a manner so as to avoid contact with or injury to any other Participant, spectator or third-party including property belonging to third parties. 

 

1.17   Participants should be vigilant so as to avoid contact with any wheelchair or its user.

 

1.18   The Participant shall receive an official numbered race bib with attached timing chip in their race pack, prior to the Event(s) sent by post, using the address provided upon completion of the Online Registration Form. A Participant’s name may be printed on the numbered race bib. If you have not received your race pack at least 7 days before the scheduled Race Day for the Event(s), please contact us using alan@btrliverpool.com

 

1.19   There are no official numbered race bibs, timing chips or race packs sent via post for Virtual Event(s) unless otherwise stated.

 

1.20   Race packs will not be posted to a Participant who provided a postal address located outside of the UK at the time of completing the Online Registration Form and race packs must be collected from the Help Desk prior to the Event(s) start time. 

 

1.21   Race packs may be mailed to an alternative UK destination upon a request by the Participant and provision of a UK mailing address, unless the deadline has passed for race packs being sent out. The Participant should contact the Event Organiser using alan@btrliverpool.com to make such a request.

 

1.22   The Event Organiser accepts no responsibility for the non-delivery of race packs. If the Participant does not receive their race pack prior to the Event(s) it is the Participants responsibility to contact the Event Organiser, where arrangements can be made regarding the issue of another race pack for collection on Race Day. 

 

1.23   The Event Organiser shall be entitled to charge the Participant a fee for replacement race packs or replacement official numbered race bibs.

 

1.24   The official numbered race bib is personal to the Participant and the Participant undertakes and agrees:

 

(i) to clearly wear the official numbered race bib assigned to the Participant’s Entry Place for the duration of the Event(s) and not to cut, fold or otherwise alter the official numbered race bib

 

(ii) not to authorise or permit any third party to use their official numbered race bib in the Event(s) 

 

(iii) not to allow any third party to participate in the Event(s) in their place
This is for the Participant’s own safety. Breaching these regulations may cause misidentification and/or potentially delay and inhibit the correct administering of medical treatment in a medical emergency. If a Participant is found to be in breach of this clause the Event Organiser reserves the right without liability, to immediately disqualify the Participant and any other relevant Participant involved, from the Event(s; and/or exclude the Participant and any other relevant Participant from involvement in any future Event(s).

 

1.25   The Participant is required to wear the Event(s) issued timing chip during the entire

duration of the Event(s). It is a condition of the Event(s) that you cross all timing mats provided and are recorded passing any timing or recording points on the route.

 

1.26   The Event Organiser reserves the right without liability, to prevent any Participant who arrives at the Event(s) after the advertised start time and after the start line has closed, from starting the race.

 

1.27   Prizes related to age groups will be based on the Participant’s age on Race Day. If a Participant qualifies for more than one prize, the prize of the higher value will be awarded.

 

1.28   In the interest of fairness, no prizes are offered for the Virtual Event(s). Each Participant completes different routes, encounters different terrain and weather conditions, therefore their times are not directly comparable.

 

1.29   The Participant must be able to maintain a pace of at least 4.5 miles per hour and to complete the Event(s) in the following times:

 

(i) 10K course in 1 hour 30 minutes

 

(ii) Half Marathon course in 3 hours

 

(iii) 10 Mile course in 2 hours 15 minutes
There are cut-off points where a Participant may be withdrawn from the Event(s) for their own safety.

 

1.30   Toilet facilities are provided at the start/finish and on the course of each Event(s). The Event Organiser reserves the right without liability, to immediately disqualify from the Event(s) and/or exclude from future Event(s), any Participant found urinating or defecating anywhere other than in a recognised toilet.  

 

1.31   The Event Organiser will share Participant Personal Data with Event Service Providers to the extent necessary to undertake the provided Event Service. 

 

1.32   The Event Organiser will share Personal Data with associated Race Charity where a Participant has indicated they intend to fundraise for the associated Race Charity. 

 

1.33   The Event Organiser may share limited Personal Data with major events such as London Marathon and Boston Marathon to establish qualification status, if requested by such organisations.

2. REFUNDS & TRANSFERS

 

2.01    The Entry Fee is non-refundable except in accordance with clause 2.03 or 3.05 below.

 

2.02    The Participant cannot defer or transfer their Race Place to another Race or Virtual Event(s).

 

2.03    Any Participant will be entitled to cancel their Race Place and receive a full refund (including any added extras at the time of completion of the Online Registration Form), within 14 days of purchase, unless a Race Place is purchased within four weeks of Race Day, or if the race sells out of general entries within 14 days of entry. 

 

2.04    A £5.00 administration fee will be deducted from all refunds. 

 

2.05    To request a refund in accordance with Clause 2.03 please contact alan@btrliverpool.com stating clearly the desire to withdraw and putting the word WITHDRAWAL in the subject line of the email. Withdrawals will not be accepted by telephone or post. 

 

2.06    No refunds shall be provided for any donations that are made during the completion of the Online Registration Form and purchasing of a Race Place.

 

2.07    Race Places are not able to be deferred to another future Event(s) or Virtual Event(s) unless under clause 2.09 and 3.03.

 

2.09    This clause only applies for Events(s) taking place in 2021. If a Participant, due to a local lockdown, quarantine, self-isolation or another reason is not able to attend an Event(s), providing they retain a valid Race Place to the Event(s); they may transfer their Race Place to run a Virtual Event(s) of the same name and of at least the Event(s) distance between 20th June and 15th August for the Mersey Tunnel 10K and Liverpool Skyline / 10 Mile race, 22nd August and 24th September for the Off Road 8 event. A Participant is required to contact alan@btrliverpool.com to transfer a valid Race Place to a Virtual Event(s), stating in the subject line I’D LIKE TO RUN {INSERT EVENT NAME} MY OWN WAY. The Event Organiser shall then provide the Participant with the required details to complete and submit their data. 

 

2.10    The Virtual Event(s) Entry Fee is non-refundable and can-not be deferred to another future Event(s) or Virtual Event(s), transferred to someone else, under any circumstance, as the Participant has opted to complete the Virtual Event(s) in their own time between the stipulated dates.

3. CHANGE OR CANCELLATION TO THE EVENT(S)

 

3.01    The Event Organiser reserves the right without liability (except as set out below in clause 3.03), to change the time, date, start/finish, location, route and format of the Event(s), to deliver an Alternative Event and/or to postpone and/or cancel the Event(s), in whole or in part, in response to a Force Majeure Event and/or any other reason deemed necessary by the Event Organiser that would impact on the delivery of the original planned Event(s).

 

3.02    If the Event Organiser has deemed it necessary to make changes to the Event(s) before Race Day, as stipulated in clause 3.01, they will make every reasonable effort to notify the Participant (via the contact details provided during the completion of the Online Registration Form) of any changes made to the Event(s) and how it may affect your participation.

 

3.03    If the Event Organiser has to postpone or cancel the Event(s) due to a Force Majeure Event, they will make every reasonable effort to notify the Participant (via the contact details provided during the completion of the Online Registration Form) and your Race Place will automatically be deferred to the next scheduled race date for the Event(s) free of charge. 

 

3.04    If a Participant is not able to run on the re-scheduled date, there will be other options available which will be communicated to them at the time. Any other options available and communicated to a Participant will need to be actioned within the stipulated time frame specified by the Event Organiser, at the time they get in contact with you. Failure to comply with any stipulated time frame will result in you waiving your rights to the options offered to you.

 

3.05    If the Event(s) is ultimately cancelled as a result of a Force Majeure Event and an alternative date cannot be arranged, should the Event Organisers race cancellation insurance policy pay out, the Participant will be offered a refund.

 

3.06    The Race Organiser may be required to implement specific rules, measures or instructions in accordance with Communicable Disease Guidelines at the Event(s), that will be mandatory for the Participant to abide by throughout their attendance at and during the Event(s). 

 

3.07    Any rules, measures or instructions implemented by the Event Organiser at the Event(s) to comply with potential Communicable Disease Guidelines, will be clearly communicated to the Participant in advance of Race Day.

 

3.08    If a Participant is found to be in breach of any rules, measures or instructions implemented by the Event Organiser as required by Communicable Disease Guidelines, the Event Organiser reserves the right without liability to immediately disqualify the Participant and/or exclude from any future Event(s).

4. MEDICAL & LIABILITY 

 

4.01    The Participant acknowledges that participation in and training for the Event(s) or Virtual Event(s) carries with it inherent risks and dangers which cannot be eliminated completely, which, without prejudice to the generality of this clause 4.01, may include accidents, personal injury (ranging from minor discomfort to catastrophic injuries and death) and loss or damage to property due to falls, obstacles, contact with other Participants, the acts and/or omissions of other Participants, the effects of weather, traffic conditions and the conditions of any road. It’s the responsibility of the Participant to ensure that they are satisfied with the risks and are fully prepared to take part before commencing the Event(s) or Virtual Event(s).

 

4.02    By completing and submitting the Online Registration Form, the Participant confirms that, to the best of their knowledge, they are healthy and medically fit to take part in the Event(s) or Virtual Event(s), understand and have considered and evaluated the nature, scope and extent of the health and associated participation risks involved and those mentioned in clause 4.01. The Participant therefore voluntarily and freely choses to assume all risks associated with training for and participating in the Event(s) or Virtual Event(s) and absolves the Event Organiser of all liability (except where any such personal and bodily injury, including death, is caused by the negligence of the Event Organiser). 

 

4.03    The Participant is advised to consult with a medical professional prior to entering into the Event(s) or Virtual Event(s) especially if they have not exercised for some time.

 

4.04    Should any medical or physical condition arise prior to the Event(s) or Virtual Event(s)  which is likely to affect the Participant’s ability to compete in the Event(s) or Virtual Event(s), and/or a medical professional advises them against taking part in the Event(s) or Virtual Event(s), the Participant should withdraw from the Event(s) or Virtual Event(s). 

 

4.05    The Event Organiser will take all reasonable steps to assess the suitability and safety and of the Event(s) course prior to Race Day. 

 

4.06    The Participant and any spectators attend, take part and spectate at the Event(s) or Virtual Event(s), entirely at their own risk.

 

4.07    The Event Organiser shall arrange for the appropriate level of medical cover to be supplied by the Medical Provider, according to the requirements of the Event(s), and use reasonable endeavours to ensure any medical cover is available for the duration of the Event(s).

 

4.08    The Participant consents to the appointed Medical Provider and their personnel (both on-site or on-call) to administer first aid treatment or any medical treatment to the Participant or to transport them in the event of any illness, accident or injury suffered by the Participant in connection with their participation in and/or attendance at the Event(s). 

 

4.09    The Participant acknowledges and agrees that the Event Organiser, Sponsor(s) & Partner(s), Event Service Provider, Race Charities and Event Agents and Guests will not be liable for any claims, actions, proceedings, loss, injury (including death), damage, costs or expenses suffered or incurred as a result of a Participant attending at, participating in, or training for the Event(s) or Virtual Event(s).

 

4.10    The Participant must not attend the Event(s) or complete the Virtual Event(s) if feeling unwell and/or suffering any symptoms of a Communicable Disease(s), especially COVID-19, and/or has tested positive for COVID-19 and/or has been potentially exposed to someone who has tested positive for COVID-19 within or outside of your household, all within 14 days prior to the Race Day. 

 

4.11    The Event Organiser reserves the right without liability, to refuse to allow a Participant to take part in, withdraw from and disqualify from the Event(s), any Participant deemed to have or to be in breach of clause 4.10. You will be risking your own health and the health of others. Instead, it’s vital you follow the latest government guidelines found here.

 

4.12    The Participant understands that the Event Organiser will take the appropriate measures to ensure the safety and wellbeing of all Participants and including, without limitation, to staff, contractors, spectators, volunteers, or any other person(s).

 

4.13    The Participant understands that large crowds pose inherent risks of contracting Communicable Disease(s) from other people before, during, and/or after the Event(s), which the Event Organiser, Sponsor(s) & Partner(s), Race Charities, Event Service Providers and Event Agents and Guests will not be liable for should you develop symptoms of a Communicable Disease. 

 

4.14    The Participant is required to complete the emergency contact and medical details form on the back of their official numbered race bib, in case of a medical emergency on Race Day. Any known medical condition or known medication must be detailed on the reverse of the race number.

 

4.15    The Event Organiser, Event Marshals and members of the Medical Provider reserve the right without liability, to disqualify and remove any Participant they consider to be putting their own safety and welfare and/or the safety and welfare of other Participants at risk.

 

4.16    In the event of any dispute the decision of the Race Director and Event Organiser shall be final.

 

4.17    A baggage facility may be provided by the Event Organiser at the Event(s) and whilst the Race Organisers will take care to secure possessions, no responsibility or liability will be accepted whatsoever by The Event Organiser, Sponsor(s) & Partner(s), Race Charities, Event Service Providers and/or Event Agents and Guests for any loss or damage to possessions. Possessions left at a baggage facility at the Event(s) are left entirely at the Participant’s own risk.

 

4.18    The Event Organisers, Sponsor(s) & Partner(s), Race Charities, Event Service Providers and/or Event Agents and Guests will not accept liability for any accidents, damage or loss incurred whilst parking at the Event(s).

 

4.19    If the Event Organiser is unable to comply with any of its obligations under the conditions including organising the Event(s) or Virtual Event(s), the Event Organiser shall not be liable to the Participant for any loss, damages or expenses incurred by the Participant.

 

4.20    Nothing in these Terms and Conditions shall affect the Event Organiser’s liability:

 

(i) for death or personal injury resulting from the negligence of the Event Organiser or a

deliberate act or omission of the Event Organiser, its employees or agents;

 

(ii) for breach of statutory duty;

 

(iii) for fraudulent misrepresentation; or

 

(iv) to the extent that liability cannot be excluded or limited by law.

5. HOW WE USE PERSONAL DATA

 

5.01    For the purposes of the Data Protection Laws the controller of any personal data processed under these Terms and Conditions is the Event Organiser.

 

5.02    The Event Organiser takes its responsibilities under the Data Protection Laws seriously and will only process your Personal Data in accordance with its obligations under the Data Protection Laws. More information regarding how the Event Organiser processes Personal Data and who they share Personal Data with is set out in its Privacy Policy, available on their Website or via this link. You may contact the Event Organiser about the processing of any Personal Data by emailing alan@btrliverpool.com

 

5.03    Your Personal Data will only be processed by The Event Organiser in order to provide services in relation to the Event(s) or Virtual Event(s) or where you have given them consent to stay in touch with you. Consequently, it may be necessary for the Event Organiser to share your Personal Data with third parties (such as in the administration and organisation of the Event(s) or Virtual Event(s) and/or future Event(s) or Virtual Event(s)). For example, the Event Organiser has appointed Event Track as the Race Entry Provider, which provides the Online Registration Form. TDL Event Services provide event timing where appropriate.

 

5.04    The Participant consents to the Event Organiser and any of its Event Service Providers having the right and licence to photograph and/or interview and/or film the Participant before/during/after the Event(s) and to use such interviews, photographs and filming, the Participant’s name, likeness and image, voice, video and film portrayals and other means of identification of the Participant, and any other information or data related to the Participant (including race times and results) in all current and future media, in any form, anywhere in the world in connection with the production, advertisement, marketing or promotion of the Event Organiser, the Event(s) or Virtual Event(s) and any future Event(s) or Virtual Event(s).

 

5.05    The Participant consents to the Event Organiser having the right to publish the Participant’s name, finish times and photos linked to their chip timing on the Website and on the Race Entry Providers website and/or for the purposes of athlete tracking. 

 

5.06    The Participant consents to the Event Organiser sending the Participant information about and in relation to the Event(s) and/or Virtual Event(s) and/or information relating the Participant’s Race Place both before and after the Event(s) or Virtual Event(s). 

 

5.07    The Event(s) or Virtual Event(s) information referred to in clause 5.06 may from time to time include information from the Event Organisers Sponsor(s) & Partner(s).  

 

5.08    All Event information provided in accordance with clause 5.06 shall be communicated by the Event Organiser who will not share the Participant’s Personal Data with Sponsor(s) & Partner(s) unless the Participant has actively consented to being contacted by the Event Organisers Sponsor(s) & Partner(s).

 

5.09    To opt-out of receiving communications from the Event Organisers Sponsor(s) & Partner(s), the Participant will need to contact the applicable Sponsor(s) & Partner(s). The Event Organiser is not responsible for the communications or the content of any communications a Participant receives from any such Sponsor(s) & Partner(s).

 

5.10    The Event Organiser takes the health of all Participants taking part in the Event(s) extremely seriously and where it is considered necessary in order to protect the vital interests of the Participant, may:
a) Use any medical information submitted during the completion of the Online Registration Form or on the back of the Participant’s official numbered race bib to treat or otherwise assist the Participant as a result of illness or injury at the Event(s);
b) Provide the Participant's medical information to the Event(s) Medical Provider, or any doctor or hospital for the purpose of providing the Participant with treatment; and
c) Use any emergency contact information provided by the Participant during the completion of the Online Registration Form or on the back of the Participant’s official numbered race bib, to inform the emergency contact of any incident at the Event(s). 

5.11    The Event Organiser acknowledges that the Participant has the rights under the Data Protection Law to obtain a copy of his/her Personal Data held by the Event Organiser or the right to have his/her Personal Data deleted in certain circumstances. 6. PARTICIPANT DECLARATION

 

6.01    The Participant agrees to be bound and abide by these Terms and Conditions when completing the Online Registration Form to purchase a Race Place for an Event(s) or Virtual Event(s).

 

6.02    If the Participant does not agree to these Terms and Conditions, they may not enter the Event(s) or Virtual Event(s). 

 

6.03    There are no rights of redress for failing to comply with these Terms and Conditions.

 

6.04    The Event Organiser reserves the right to reject, at any time, any Online Registration Form which is found or believed to be fraudulent and/or disqualify any Participant believed to have not complied with these Terms and Conditions and/or exclude the Participant from any future Event(s) or Virtual Event(s).

 

6.05    The Event Organiser shall not be liable in any way to the Participant as a result of any such disqualification or refusal resulting from clause 6.04.

 

6.06    The Participant agrees to indemnify the Event Organiser in relation to any claims, action, liabilities or losses resulting from any breach of these Terms and Conditions by the Participant

 

6.07    By using our website, the Participant agrees to abide with our Site Usage Policy.

 

6.08    The Participant is expected to review this page, to be aware of any changes.

These Terms and Conditions were lasted updated in October 2020. The Participant agrees to be bound by any such modification.

7.GENERAL PROVISIONS

 

7.01    The Event Organiser reserves the right to review and amend the Terms and Conditions from time to time prior to the Event(s) or Virtual Event(s) and the up to date terms shall be available on the Website.

 

7.02    If any provision in these Terms and Conditions, whether in part or in full, is held to be invalid or unenforceable, all other remaining provisions (in part or in full) shall continue to be valid and enforceable.

 

7.03    These Terms and Conditions shall be subject to the law of England and Wales and the Parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

 

7.04    An individual who is not a party to these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Terms and Conditions.

 

7.05    The Participant may not transfer, assign or deal in any manner with these Terms and Conditions or any of its rights without the prior written consent of the Event Organiser. The Event Organiser may assign or transfer its rights and obligations under these Terms and Conditions without the consent of the Participant.

 

7.06    These Terms and Conditions and the documents referred to herein or notified to the Participant prior to the race, constitute the entire agreement and understanding between the Parties and supersede any previous agreement between the Parties relating to the subject matter herein. The Participant acknowledges that they have not, in entering into these Terms and Conditions, relied on any statement, representation or assurance that is not expressly set out in these Terms and Conditions or any document referred to herein.
